Covenants, Conditions, and Restrictions for Russell Gardens

A lot in Russell Gardens comes with more than land and a house. All homeowners in this planned community contribute to the maintenance of common areas, including landscaped walkways and irrigation systems. To manage these facilities and to maintain neighborhood wellbeing, each owner is bound by a legal document known as Covenants, Conditions, and Restrictions (aka CC&Rs). 

In a sense, the CC&Rs are the operating instructions for the Russell Gardens Homeowners Association. They create legally binding responsibilities for homeowners to collectively manage the landscape, assess fees for services and coordinate private property improvements. Making the CC&Rs work requires cooperation from all owners.

The provisions include the following:

  1. Owners annually elect a Board of Directors with the power to create a budget, assess fees for maintenance and long-term capital expenses, contract for services, and create and enforce guidelines for private property improvements.

  2. Lots are restricted to residential (non-commercial) uses.

  3. No livestock, including poultry, is permitted. While household pets are welcome, they must be on leash when outside homes and fenced yards.

  4. All property improvements are subject to an Architectural Review Committee (ARC) appointed by the Board of Directors and composed of volunteers from the community.

  5. No vehicles may be parked in yards or the access alleys. Parking recreational vehicles (RVs, trailers, boats, etc.) is not permitted on public streets for more than 48 hours.

  6. The Russell Gardens HOA maintains all landscaping outside fenced yards, including front yards and common areas along streets and alleys. 

  7. Owners may rent their homes as long as tenants receive a written lease and abide by the CC&Rs.

  8. Garbage and recycling carts must be removed from the street or alley within 12 hours of pickup.
